How Federal Gun Background Checks Work

The Second Amendment to the United States Constitution guarantees the fundamental right of Americans to keep and bear arms.

Purchasing a gun in the US, however, is subject to a federal background check, that is, if you buy a gun through a Federal Firearms Licensee (FFL). Retailers at Walmart and other smaller- brink-and-mortar shops selling guns fall under this category.

Should you find yourself charged with any violation of the Gun Control Act, you will need to have a gun criminal defense lawyer by your side to help you mount an effective defense in court.

If you decide to purchase a gun at a federally-licensed retailer;

Here is what you will have to go through:

Fill out a 4473 form – All prospective gun buyers at FFLs are required to fill out the Bureau of Alcohol, Tobacco, Firearms and Explosives’ 4473 form, also known as a Firearms Transaction Record. It asks for your basic information, including your full name, address, sex, birth date, and ethnicity. The form also asks questions about your immigration status, mental health, and any criminal background, all of which could lead to a denial of purchase.

Providing false information on the form is a felony which is punishable by up to 10 years in prison as well as a $250,000 fine.

NICS check—Once you’re done filling out the federal form, the retailer or person selling you the gun will run the information you provided in it through the FBI-maintained National Instant Criminal Background Check System (NICS).

The NICS check will take about 30 seconds. You can proceed with the purchase if the background check doesn’t find anything on your record that will indicate you are prohibited from buying a firearm. However, if the background check registers a hit, the NICS will mark the form as “canceled” or “denied,” and the dealer cannot legally sell the gun to the prospective buyer.

When a NICS background check returns a “delayed” response, the transaction will be on hold for at least three business days. In that period, the seller will have to wait for NICS to designate the transaction as “denied.” However, if the three-day period elapses without a cancellation or a denial, the transaction can proceed under federal law.

Who is prohibited from owning a firearm?

Under federal law, a person is not allowed to legally own a gun if he or she is any of the following:

A drug user or addict
Dishonorably discharged from the U.S. Armed Forces
A convicted felon sentenced to a prison term of more than a year
A fugitive from justice
An illegal immigrant
Convicted of misdemeanor domestic violence
Mentally-ill as declared by a court or have been committed to a mental institution
An ex-US citizen who renounced his/her citizenship
Subject to a court restraining order issued on behalf of an ‘intimate partner,’ a partner’s child, or children

Private Sale Exemption

Also referred to as the gun show loophole, the private sale exemption refers to the absence of the background check requirement for private-party sellers of firearms. That means people buying guns online, from a gun show, and from other dealers that are not federally-licensed can just get the firearm of their choice without being checked whether or not they are eligible to own a gun under federal law. It is this loophole that has allowed convicted felons, drug addicts, illegal immigrants, domestic abusers, and other ineligible people to purchase guns legally.

However, some states have stepped in and have plugged this loophole by requiring unlicensed sellers to perform background checks on gun buyers.

Still, even with this background check system in place, offenses that involve firearms continue to take place, with some offenders unjustly facing weapons charges for one reason or another.

Why You Should Shoot Your Gun AFTER Cleaning it

The title sounds pretty confusing, shoot your gun after cleaning? Wouldn’t that negate the entire cleaning?

The idea is, that after take apart your gun to clean it, you have to put it back together and perform a function check, but since you don’t actually fire it, you aren’t 100% sure that the gun works.

In several law enforcement courses I have taken I have heard anecdotal stories of an unnamed police officer that has some essential piece inside their pistol break during cleaning at the annual firearm re-qualification, carried the inoperable firearm all year and never knew it did not work until the next year’s range.

I cannot verify the story. It sounds like a 1 in a million stroke of bad luck. However, what can it hurt to shoot your gun after cleaning it?

Especially since many glock owners take the marketing hype of glock seriously and never clean their firearms. Seriously, a single round in a clean gun in modern times won’t impact anything – we aren’t talking about corrosive ammo in a WWII bolt gun.

I do think this is a little on the high odds side of things, BUT – getting in a gunfight is also on the high odds against side of things and I still prepare for it.

I just read that YouTube Officially To Start Banning Firearms Related Content and followed the link to the official youtube policy. Because of this I immediately began removing those “offending” videos from YouTube so as not to lose my entire channel.

While I think this is a shortsighted and anti-American decision, this is a free market and they do have the right to remove those creators that don’t post what they want. Personally I think it is chickenshit modern day book-burning, but you shouldn’t get to pick and choose what rights you want to enforce if you believe that our way of life means anything. I wish the other side of the political spectrum was that honest.

I get that they are afraid of guns, I get that they are afraid that the gun owners will rise up against them, after all if they had the numbers and the guns they would rise against us.

What I don’t understand is how hypocritical and ignorant the entire discussion is. People with no understanding of facts are dictating policy. The willful ignorant should not be the deciding voice.

If I owned a media outlet that allowed uploading of information I could not, in good conscious pick and choose who posted. Especially by silencing the voice of the law abiding citizen. I mean, sure libs hate guns, but everyone hates pedophiles – I had to ban my boy from YouTube because of all the overtly sexual content that is hidden as kid friendly material. You’d think they would fix THAT.

I will upload the offending videos directly to this website, and I am working on finding solutions to being dependent of youtube for the funding to do the videos I produce.

I started a channel on Dailymotion, it is a french company that is not quite as big as YouTube, but it is large enough to be a competitor.

Right now I am just uploading and embedding the videos YouTube has demonitized, but that is because I have over a thousand videos. However, the goal is to completely remove YouTube.

As I said, they are a private company, and have the right to do what they want, but they are not free from the consequences of their decisions. Which is the loss of some of their best content creators (not that I an one of the best, but I am a member of one of their most popular niches)

For myself, as the owner of this site I wanted to add my thoughts as I carried a neck knife everyday for 15 years – even in places that did not allow concealed weapons (its a tool right)… For utility and easy carry a neck knife is hard to beat. Preppers and survivalists are always discussing survival knives and that they might actually be the most important gear you carry. Not many discuss the importance of where you wear your survival knife though. Throughout history man has worn a knife from a chain around their necks.

This includes Native Americans and Vikings. In modern times Mors Kochanski who is recognized as the granddaddy of bushcraft and who actually wrote the book on bushcraft uses a neck knife and even more recently Cody Lundin from Dual Survival fame also wears a neck knife as their primary knife.

In this article I’ll go over what are the pros and cons of a neck knife.

Pros of neck knives

Because it’s so small and light, it can easily be used as a back up blade if your primary blade breaks or gets lost. Your blade might be your most important piece of equipment you carry so always having a decent back up blade is handy
Sitting on the ground or on a log with a knife on your belt can be annoying
If it’s worn on the inside of your shirt, you’ve got a hidden knife that others won’t know about unless they give you a hug. Even though there are better weapons when shtf the neck knife could be used as a weapon of last resort
If needed, most neck knives can be switched to be carried on your belt
It allows you to not have to wear a belt which means you have more flexibility in the pants or shorts you choose to wear
If you’re walking through a creek or small stream and it goes to about waist height, if you’re wearing a neck knife it won’t get wet
They’re inexpensive so preppers with a tight budget can afford them as a good backup knife

Cons of neck knives

If it’s worn on the outside of your shirt, it can get in the road every time you bend over which is annoying
It it’s worn on the inside of your shirt, it’s hard to get to quickly
If the chain is made out of beads it can pull at your chest hairs and I’m not a fan of having my chest hair pulled out
It’s not practical to have a big knife dangling around your neck because it will just get in the way. So if the knife is small it doesn’t lend itself to heavy duty tasks like chopping or batoning but if you’re primary chopping tool is an axe or machete you can get away with carrying a small bladed knife as your blade to do the finer tasks like processing game or whittling wood
When you re-sheath, you’ll need both hands
If the chain is not a break away type of chain it can be a choking hazard if worn on the outside of your shirt
If it is a break away chain, the chain could snap at an inconvenient time meaning you’d end up carrying the neck knife on your belt or in your pocket.
